These terms are an agreement between you and High Impact ("High Impact", "we" or "us"). They apply when you list your services on High Impact as a professional or a mentor. They sit alongside our Terms of Use and our Privacy Policy, which also apply to you. If these terms and the Terms of Use disagree about your listing, these terms win.
You accept these terms at the Policies step when you set up your listing.
1. Our relationship
High Impact is a marketplace that helps members find and book you. You are an independent professional running your own practice. You are not our employee, partner or agent, and nothing in these terms makes you one. You decide how you provide your services, and you are responsible for them.
2. Joining
Joining is by invitation only. Our team adds you, sends you an invitation, and you claim your listing by setting a password.
Before your listing goes live, you complete your listing details, your services, your available times and these policies. You may also add these documents, now or later:
- your registration or licence with your professional body, where your work is regulated, and
- proof of current professional liability insurance for the work you list.
Your listing goes live as soon as these are complete, unless we tell you when you join that our team will look at it first. Our team may pause, decline or remove a listing at its discretion.
The "Checked by High Impact" mark on your listing means you joined by our invitation and gave us your registration details. It is not a guarantee of your services, and you must not describe it as an endorsement beyond that.
Mentors share lived experience. A mentor does not offer treatment or professional advice, and every mentor listing says so and points members to a qualified professional where they need one. If you are listed as a mentor, you must not present yourself as qualified to treat or advise.
3. What you promise
You confirm, when you accept these terms and for as long as you are listed, that:
- you hold every registration, licence and qualification your work requires, and they are current and in good standing;
- you are insured for the work you list;
- you will work only within your scope of practice and follow the standards, codes of conduct and rules of your professional body;
- everything on your listing is true and up to date, including your qualifications, services, prices, locations and hours;
- you will comply with all laws that apply to your practice, including privacy, consumer protection, human rights, tax and anti-spam laws.
Tell us at connect@highimpact.app within 5 business days if your registration or insurance lapses, is suspended, restricted or cancelled, or if you become the subject of a disciplinary finding that affects the services you list. We may pause your listing until it is resolved.
4. Your services, and your responsibility for them
You alone are responsible for the services you give, including any assessment, advice, treatment, informed consent, record-keeping, and follow-up. High Impact does not supervise, direct or check your work.
If a member tells you about an emergency or a risk to their safety, act as your professional obligations require. High Impact is not an emergency service.
5. Bookings
At launch, members can book only a free introductory call with you. No money moves between you and members through High Impact.
- A booking is confirmed as soon as the member confirms it. You do not accept or decline it. Keep your available times accurate, so you are only booked when you can attend.
- Changes to your repeating hours apply from the moment you save them. Times already booked are never affected.
- If you connect a Google calendar, we read only the times you are busy, so those times are not offered to members. We never see the details of your events and never write to your calendar.
- Members can move a booking up to two times, and cancel, up to 24 hours before it starts. You are told either way.
- You can cancel a booking, but you must give a reason, and the member sees it. Please cancel only when you have to, and as early as you can.
- Mark a member as not having come only when that is what happened. Missed appointments are reviewed by our team and can affect the member's account.
- For in-person services, your full street address is shown to a member only once their booking is confirmed.
6. Members' information
When a member books you, you receive their name, the contact details and note they give, and the booking details. If the member chooses to share their health profile, you see their height, weight, blood group, allergies, medications and conditions for that appointment only. It stops being visible to you through High Impact when the appointment ends or is cancelled.
You may use members' information only to provide the booked service and to communicate with that member about it. You must not:
- use it to market to members who have not asked you to, or add them to mailing lists without their consent;
- sell it, share it with others, or copy it out of High Impact in bulk;
- ask members for health information you do not need for the service.
Once you have collected information from a member for your practice, you are responsible for it under the privacy laws and professional rules that apply to you (for example, as a health information custodian where you are one). You must protect it and keep it only as long as those rules allow or require.
7. Your listing and content
You own the content you add to your listing, such as your photo, description and service details. You give us a non-exclusive, royalty-free licence to show, format and promote it on High Impact and in our marketing about High Impact, for as long as you are listed, and for a reasonable time after in materials already published.
You must have the right to everything you upload, and it must not be misleading. We may edit your listing for format or length, and may remove anything that breaks these terms.
Any registration or insurance documents you add are private. Members never see them.
8. Reviews
Members can review you only after attending an appointment with you. You must not offer anything in exchange for a review, write reviews of yourself or of others, or pressure a member about a review. We may remove reviews that break our rules, but we do not remove honest reviews because they are unfavourable.
9. Live classes
If you host a class on High Impact, you must follow our class rules: start and end on time, keep the class and chat respectful and on topic, and do not record the class or members in it. Class prices, refunds and cancellations are set out in the Terms of Use. If a class you host is cancelled, every member who paid is refunded in full.
10. Fees
There are no fees for professionals at launch.
If we introduce fees, paid appointments or payouts, we will give you at least 30 days' written notice and updated terms before they apply to you. You can close your listing before then if you do not agree.
11. How to behave
Keep professional boundaries with members at all times. Do not harass, discriminate against, exploit, or behave inappropriately towards any member, and do not use High Impact to promote anything unrelated to your listed services.
12. Pausing or removing your listing
We may pause or remove your listing, with notice where it is reasonable to give it, if:
- your registration or insurance is not current, or we cannot confirm it;
- you break these terms or the Terms of Use;
- we receive complaints we reasonably believe put members at risk;
- the law requires it.
You can ask to leave High Impact at any time by writing to connect@highimpact.app. Please cancel your upcoming bookings first, with a reason, so members are told. What happens to your information when you leave is described in the Privacy Policy.
13. Responsibility and indemnity
We provide High Impact as it is, and we do not promise it will always be available or error-free, or that you will receive any number of bookings.
To the extent the law allows, we are not liable for indirect or consequential losses, or for lost income, and our total liability to you is limited to $100.
You agree to cover High Impact for claims, losses and costs that arise from your services, your breach of these terms, or your breach of the law, except to the extent they were caused by us.
14. Changes to these terms
We may update these terms. If a change matters, we will tell you by email or in the app before it takes effect, and for a change about fees we will give you the 30 days' notice in section 10. If you keep your listing after the change takes effect, the new terms apply.
15. Law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. Please write to us first if you have a problem. If we cannot resolve it, disputes will be heard by the courts of Ontario.
