These terms are an agreement between you and High Impact ("High Impact", "we" or "us"). They cover the High Impact app, our website and everything you do through them (together, "High Impact"). Please read them. By creating an account you agree to them, and to our Privacy Policy, which explains what we do with your information.
If you have a question about these terms, write to connect@highimpact.app, or by post to High Impact, 178 John St, Unit 204, Brampton, ON L6W 3X4, Canada.
1. What High Impact is
High Impact is a place to find and book independent professionals and mentors, join live classes, discover events, and keep track of your own health and wellbeing.
High Impact is a marketplace. We are not a clinic, a health care provider, a financial adviser or a business adviser, and we do not provide care, treatment or advice ourselves. The professionals and mentors on High Impact are independent. They are not our employees or agents, and they alone are responsible for the services they give you.
2. Not medical advice, and not for emergencies
Nothing on High Impact is medical, psychological, financial, legal or other professional advice from us. The health tools (mood, sleep, water, food, weight, blood pressure, blood sugar, goals and the journal) are for your own tracking. Figures such as calorie goals and food estimates are approximate, and ranges shown beside a reading are general guidance, not a diagnosis.
Always talk to a qualified professional about your own health, and do not delay getting care because of something you read or logged here.
High Impact is not an emergency service. If you are in danger or having a medical emergency, call 911. If you are thinking about suicide or are worried about someone, call or text 9-8-8 (Suicide Crisis Helpline, available across Canada, at any time).
3. Who can use High Impact
You must be at least 13 years old to use High Impact. If a higher minimum age applies to you under the law where you live, or under the terms of the App Store or Google Play, that higher age applies. When you create an account you confirm that you are 13 or older, and we do not accept a date of birth that shows you are younger. This matches our Privacy Policy. [Lawyer to confirm: whether someone aged 13 or over but under the age of majority in their province may hold an account on their own, or only with a parent or guardian's consent, given that the app holds health information and takes payments.]
High Impact is offered to people in Canada. At launch our professionals and services are in British Columbia, Alberta and Ontario, and the app is in English.
You must give us accurate details when you sign up and keep them up to date. One account is for one person.
4. Your account
Keep your password to yourself and tell us straight away at connect@highimpact.app if you think someone else has used your account. You are responsible for what happens under your account unless it happened because of our failure.
For your protection, the app signs you out if you have not opened it for 30 days.
You can close your account at any time from Profile, under Your data and account. See section 13.
5. Booking a professional
At launch, the only appointment you can book is a free introductory call. No payment is taken for it and no card is needed.
How bookings work:
- A booking is confirmed as soon as you confirm it. The professional does not have to accept it, and both of you are sent a confirmation.
- Some services are in person, some by video and some offer both. If a service offers both, you choose when you book.
- A professional's full street address is shown to you once your booking is confirmed.
- You can move an appointment up to two times, as long as each move is made more than 24 hours before it starts.
- Please cancel at least 24 hours before if you cannot make it, so someone else can have the time. You can cancel from My bookings.
- A professional can cancel a booking. If they do, they must give a reason, and you will see it.
Missed appointments. These calls are free, and a missed call is a time someone else could have had. If you miss appointments without cancelling, we may look at your account. When you reach three missed appointments, a member of our team reviews what happened and may suspend or close your account. We do not do this automatically.
When paid appointments are introduced, we will update these terms to explain prices, fees, cancellations and refunds for them, and tell you before the change takes effect.
6. Live classes
Classes are run live, at a set time, inside the High Impact app. Some are free and some are paid.
Enrolling. Places are limited and given first come, first served. There is no waiting list. For a paid class, your place is confirmed only once your payment has gone through.
Paying. Prices are shown in Canadian dollars before you pay. [Lawyer and client to confirm how sales taxes are shown and charged.] Card payments are processed by Stripe. Where the app offers payment through the Apple App Store or Google Play, that payment is also subject to Apple's or Google's own terms.
Giving back a place, and refunds:
- If you give back a place more than 24 hours before the class starts, a paid place is refunded in full.
- If you give it back within 24 hours of the start, it is not refunded, because the seat cannot be filled again in time.
- If we or the organiser cancel a class, everyone who paid is refunded in full automatically.
- Refunds go back to the way you paid. Your bank may take several business days to show it. For a purchase made through Apple or Google, the refund is handled through them.
Joining. The class opens 15 minutes before it starts. You can take part in the class chat and answer questions put during the class.
Recording. We do not record classes. Please do not record, photograph, screenshot or share a class or other people in it.
Class chat. Keep it kind and on topic. The chat does not allow phone numbers, email addresses or links. We or the host can remove messages and stop someone from using the chat.
7. Events
We list events run by other organisers. When you book an event, you do so on the organiser's own website (for example, Eventbrite), under their terms and prices. We are not a party to that booking and cannot refund it.
8. Reviews
You can review a professional after you have attended an appointment with them. Reviews are shown with your first name and the first letter of your last name. Reviews must be honest, your own experience, and follow the rules in section 9. We may remove a review that does not.
9. How to behave on High Impact
Treat professionals, mentors, hosts, other members and our team with respect. Do not:
- harass, threaten, abuse, or discriminate against anyone;
- post anything unlawful, hateful, sexually explicit, or that invades someone's privacy;
- pretend to be someone else, or give false information;
- use High Impact to advertise, sell or spam;
- record or share classes or other people's information without their permission;
- try to get into accounts, data or parts of the service you are not allowed to, interfere with how it works, or copy it using automated tools;
- use High Impact in a way that breaks the law.
10. Your content
Your health entries, journal, photos and documents belong to you. You give us permission to store and use them only to run High Impact for you, as explained in the Privacy Policy and the health notice.
For things you post for others to see (reviews, class chat messages, answers in a class), you give us a non-exclusive, royalty-free licence to show them on High Impact for as long as they are there. You must have the right to post them.
11. Our content
The High Impact app, website, design, text and logos belong to us or to people who have licensed them to us. You may use them only to use High Impact for yourself. Class materials are for your own personal use.
12. Emails and notifications
We send you messages you need to use High Impact: sign-up codes, booking and class confirmations, reminders, changes and cancellations, refunds, and messages about your account. These are part of the service.
We only send you news and offers if you have said yes to them. News is off until you turn it on, and you can turn it off at any time in the app or from the link in any such email.
13. Closing your account
You can close your account from Profile, under Your data and account. An account cannot close while you still have an appointment or class to come, or a refund on its way, so that nobody is left owed anything.
When you close your account, it is scheduled to close 30 days later. Until then you can change your mind and everything is where you left it. After that your personal and health information is deleted, as described in the Privacy Policy. Before you close, you can ask for a copy of everything we hold about you.
We may suspend or close an account that breaks these terms, puts others at risk, or where the law requires us to. Where it is reasonable to, we will tell you why, and you can write to us if you think we got it wrong.
14. Changes to High Impact and to these terms
We are always improving High Impact, so features may change or be removed.
We may update these terms. If a change matters, we will tell you in the app or by email before it takes effect. The date at the top shows the latest version. If you keep using High Impact after the change takes effect, the new terms apply. If you do not agree with them, you can close your account.
15. Our responsibility to you
We work hard to keep High Impact available and working well, but we cannot promise it will always be available, error-free or uninterrupted.
Professionals, mentors, class hosts and event organisers are independent, and we are not responsible for their services, advice, conduct, or for what happens at an appointment, class or event. Any agreement for a service is between you and them.
To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and $100.
Nothing in these terms takes away rights you have under consumer protection law that cannot be excluded, or limits liability that cannot be limited by law.
16. Law and disputes
These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. If you have a problem, please write to us first at connect@highimpact.app and we will try to sort it out. If we cannot, disputes will be heard by the courts of Ontario, unless the consumer protection law of the province where you live gives you the right to bring a claim there.
17. General
If any part of these terms is found to be unenforceable, the rest still applies. If we do not enforce a part of these terms straight away, we can still enforce it later. You may not transfer your account or these terms to someone else. We may transfer them as part of a sale or reorganisation of our business, and your rights under them stay the same.
